Vystudovala pr\u00e1vo na Australsk\u00e9 n\u00e1rodn\u00ed univerzit\u011b a na Griffithov\u011b univerzit\u011b, je spoluzakladatelkou a n\u00e1rodn\u00ed koordin\u00e1torkou Australian Earth Laws Alliance (AELA, Australsk\u00e9 aliance pr\u00e1v Zem\u011b) a vedouc\u00ed pracovnic\u00ed v&nbsp;Centru pro budoucnost pr\u00e1va na Griffithov\u011b univerzit\u011b. M\u00e1 v\u00edce ne\u017e dvacet p\u011bt let zku\u0161enost\u00ed s&nbsp;vytv\u00e1\u0159en\u00edm a \u0159\u00edzen\u00edm program\u016f soci\u00e1ln\u00ed spravedlnosti, komunitn\u00edho rozvoje a ekologick\u00e9 spravedlnosti, v\u010detn\u011b pr\u00e1ce s&nbsp;domorod\u00fdmi lidmi v&nbsp;Queenslandu na projektech soci\u00e1ln\u00ed spravedlnosti a kulturn\u00edho d\u011bdictv\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inspirov\u00e1na Cormacem Cullinanem se v&nbsp;roce 2009 sezn\u00e1mila s&nbsp;pr\u00e1vn\u00ed v\u011bdou Zem\u011b a od roku 2011 se v&nbsp;Austr\u00e1lii sna\u017e\u00ed prost\u0159ednictv\u00edm sv\u00e9 pr\u00e1ce v&nbsp;AELA podporovat porozum\u011bn\u00ed a praktick\u00e9 uplat\u0148ov\u00e1n\u00ed ve\u0159ejn\u00e9 spr\u00e1vy zam\u011b\u0159en\u00e9 na Zemi. Tvrd\u00ed, \u017ee p\u0159i rozhodov\u00e1n\u00ed mus\u00edme br\u00e1t v&nbsp;\u00favahu nejprve Zemi a to, co Zem\u011b pot\u0159ebuje k&nbsp;p\u0159e\u017eit\u00ed a teprve pot\u00e9 se rozhodnout, jak se do t\u011bchto mez\u00ed vejdou na\u0161e \u010diny a pl\u00e1ny. V&nbsp;r\u00e1mci sv\u00e9 pr\u00e1ce pro AELA se zasazuje o pr\u00e1va Velk\u00e9ho bari\u00e9rov\u00e9ho \u00fatesu v&nbsp;australsk\u00e9m Queenslandu. Vzhledem k&nbsp;tomu, \u017ee samotn\u00e1 existence Velk\u00e9ho bari\u00e9rov\u00e9ho \u00fatesu je ohro\u017eena, za\u010dala Michele Maloneyov\u00e1 a AELA prosazovat nov\u00e9 z\u00e1kony a petice, kter\u00e9 by uznaly pr\u00e1va p\u0159\u00edrody, tedy i Velk\u00e9ho bari\u00e9rov\u00e9ho \u00fatesu, na \u017eivot a rozkv\u011bt a umo\u017enily komunit\u00e1m br\u00e1nit pr\u00e1va \u00fatesu p\u0159ed nezdravou posedlost\u00ed Austr\u00e1lie t\u011b\u017ebou uhl\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Malonyov\u00e1 vytvo\u0159ila tak\u00e9 prvn\u00ed australsk\u00fd univerzitn\u00ed kurz o divok\u00e9m pr\u00e1vu <strong>Wild Law: Theory &amp; Practice of Earth Jurisprudence <\/strong>(Divok\u00e9 pr\u00e1vo: teorie a praxe pr\u00e1vn\u00ed v\u011bdy Zem\u011b), kter\u00fd vyu\u010duje jako t\u00fddenn\u00ed intenzivn\u00ed p\u0159edm\u011bt na Griffith Law School v&nbsp;Queenslandu. Kurz umo\u017e\u0148uje student\u016fm analyzovat a kritizovat sou\u010dasn\u00fd pr\u00e1vn\u00ed syst\u00e9m a navrhovat nov\u00e9 p\u0159\u00edstupy k&nbsp;pr\u00e1vu a spr\u00e1v\u011b v&nbsp;21.&nbsp;stolet\u00ed. Dal\u0161\u00edm z&nbsp;inic\u00e1torsk\u00fdch projekt\u016f doktorky Maloneyv\u00e9 byl projekt <strong>Wild Law Judgment <\/strong>(Soud ve v\u011bci divok\u00e9ho pr\u00e1va). Tato iniciativa vznikla ve spolupr\u00e1ci s&nbsp;Univerzitou Southern Cross a vyzvala akademiky, odborn\u00edky z&nbsp;praxe, soudce a studenty, aby p\u0159epsali rozsudky kl\u00ed\u010dov\u00fdch rozhodnut\u00ed z&nbsp;oblasti zvykov\u00e9ho pr\u00e1va z&nbsp;pohledu divok\u00e9ho pr\u00e1va a vytvo\u0159ili tak soubor judikatury zam\u011b\u0159en\u00e9 na Zemi. Projekt zkoumal australsk\u00e9 soudn\u00ed rozhodov\u00e1n\u00ed a zpochyb\u0148oval hegemonii antropocentrismu ve zvykov\u00e9m pr\u00e1vu a v&nbsp;roce 2017 vyvrcholil vyd\u00e1n\u00edm knihy <em><strong>Law as if Earth Really Mattered<\/strong><\/em> (<em>Pr\u00e1vo, jako by na Zemi skute\u010dn\u011b z\u00e1le\u017eelo<\/em>), kterou Michelle Malonyov\u00e1 napsala spolu s&nbsp;Nicole Rogersovou. Ve spolupr\u00e1ci s&nbsp;Peterem Burdonem vydala v&nbsp;roce 2014 knihu <em><strong>Wild Law \u2013 in Practice <\/strong><\/em>(<em>Divok\u00e9 pr\u00e1vo \u2013 v&nbsp;praxi<\/em>), kter\u00e1 ukazuje, jak rozv\u00edjet pr\u00e1vo a ve\u0159ejnou spr\u00e1vu zp\u016fsobem, kter\u00fd uzn\u00e1v\u00e1 n\u00e1\u0161 vztah k&nbsp;\u0161ir\u0161\u00edmu spole\u010denstv\u00ed Zem\u011b. Jednou ze strategi\u00ed, kter\u00e9 se dnes dost\u00e1v\u00e1 \u010d\u00edm d\u00e1l v\u011bt\u0161\u00ed pozornosti, je zm\u011bna pr\u00e1vn\u00edho postaven\u00ed p\u0159\u00edrody z&nbsp;lidsk\u00e9ho vlastnictv\u00ed nebo v&nbsp;nejlep\u0161\u00edm p\u0159\u00edpad\u011b chr\u00e1n\u011bn\u00e9ho &#8222;p\u0159edm\u011btu&#8220; na jej\u00ed uzn\u00e1n\u00ed jako \u017eiv\u00e9 entity s&nbsp;vlastn\u00edmi z\u00e1konn\u00fdmi pr\u00e1vy \u2013 tedy jako subjektu pr\u00e1va. M\u016f\u017ee v\u0161ak tento p\u0159\u00edstup n\u011bco zm\u011bnit na pr\u00e1vn\u00ed ochran\u011b p\u0159\u00edrody? V&nbsp;t\u00e9to eseji nast\u00edn\u00edm kritiku tradi\u010dn\u00edho environment\u00e1ln\u00edho pr\u00e1va, kter\u00e1 se pou\u017e\u00edv\u00e1 jako argument pro pot\u0159ebu zm\u011bny paradigmatu v&nbsp;z\u00e1padn\u00edch pr\u016fmyslov\u00fdch pr\u00e1vn\u00edch syst\u00e9mech, a budu sledovat po\u010d\u00e1tky hnut\u00ed za pr\u00e1va p\u0159\u00edrody a jeho sou\u010dasn\u00fd v\u00fdvoj ve sv\u011bt\u011b, d\u00edky n\u011bmu\u017e se dnes pr\u00e1va p\u0159\u00edrody posunula z&nbsp;&#8222;okrajov\u00e9ho&#8220; pr\u00e1vn\u00edho t\u00e9matu na t\u00e9ma, kter\u00e9 zaujalo soudy, pr\u00e1vn\u00edky a komunity po cel\u00e9m sv\u011bt\u011b. I kdy\u017e je tento koncept potenci\u00e1ln\u011b otev\u0159en mnoha stejn\u00fdm probl\u00e9m\u016fm, s&nbsp;nimi\u017e se pot\u00fdk\u00e1 &#8222;tradi\u010dn\u00ed&#8220; environment\u00e1ln\u00ed pr\u00e1vo, p\u0159edstavuje v&nbsp;pr\u00e1vn\u00ed teorii a praxi vzru\u0161uj\u00edc\u00ed a optimistick\u00fd v\u00fdvoj, kter\u00fd je p\u0159ij\u00edm\u00e1n \u0159adou komunit a m\u016f\u017ee nab\u00eddnout \u00fa\u010dinn\u00fd zp\u016fsob, jak prosazovat demokracii Zem\u011b.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hora Taranaki na Nov\u00e9m Z\u00e9landu byla po dohod\u011b mezi osmi maorsk\u00fdmi kmeny a kr\u00e1lovskou korunou prohl\u00e1\u0161ena v&nbsp;prosinci 2017 za pr\u00e1vnick\u00fd subjekt a za \u010dlena jejich \u0161ir\u0161\u00ed rodiny (whanau).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kritika tradi\u010dn\u00edho environment\u00e1ln\u00edho pr\u00e1va<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Navzdory v\u00fdznamn\u00fdm v\u00fddobytk\u016fm modern\u00edho environment\u00e1ln\u00edho pr\u00e1va je jeho sou\u010dasn\u00fd syst\u00e9m kritizov\u00e1n jak &#8222;tradi\u010dn\u00edmi&#8220; environment\u00e1ln\u00edmi pr\u00e1vn\u00edky a koment\u00e1tory, tak t\u011bmi, kte\u0159\u00ed se ozna\u010duj\u00ed za &#8222;pr\u00e1vn\u00edky Zem\u011b&#8220;. Thomas Linzey, zakladatel Community Environmental Legal Defense Fund, uv\u00e1d\u00ed, \u017ee: \u201eenvironment\u00e1ln\u00ed z\u00e1kony jednodu\u0161e \u00b4povoluj\u00ed\u00b4 zne\u010di\u0161\u0165ov\u00e1n\u00ed \u017eivotn\u00edho prost\u0159ed\u00ed\u201c a \u017ee jedin\u00e9, co z\u00e1kon o \u017eivotn\u00edm prost\u0159ed\u00ed \u201espravuje\u201c, jsou ekologov\u00e9, proto\u017ee vl\u00e1dy a korporace se spol\u010duj\u00ed, aby kontrolovaly vyu\u017e\u00edv\u00e1n\u00ed \u017eivotn\u00edho prost\u0159ed\u00ed a ve\u0159ejn\u00fdch zdroj\u016f za \u00fa\u010delem udr\u017een\u00ed v\u00fdhod pro sv\u00e9 partikul\u00e1rn\u00ed z\u00e1jmy [1]. Pr\u00e1vn\u00edci jako Joseph Guth podali obs\u00e1hlou kritiku pr\u00e1va \u017eivotn\u00edho prost\u0159ed\u00ed a tvrd\u00ed, \u017ee nen\u00ed schopno vypo\u010d\u00edtat nebo &#8222;zvl\u00e1dnout&#8220; kumulativn\u00ed dopady lidsk\u00fdch \u010dinnost\u00ed a realitu ekologick\u00fdch limit\u016f [2].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Z pohledu pr\u00e1vn\u00ed v\u011bdy Zem\u011b jsou nedostatky modern\u00edho environment\u00e1ln\u00edho pr\u00e1va mnohem hlub\u0161\u00ed, ne\u017e jsou b\u011b\u017en\u011b pou\u017e\u00edvan\u00e9 pr\u00e1vn\u00ed n\u00e1stroje a r\u00e1mce. Tyto probl\u00e9my poch\u00e1zej\u00ed p\u0159edev\u0161\u00edm z&nbsp;p\u0159evl\u00e1daj\u00edc\u00edch kulturn\u00edch sv\u011bton\u00e1zor\u016f, je\u017e utv\u00e1\u0159ej\u00ed pr\u00e1vn\u00ed syst\u00e9m. Navzdory v\u011bdecky podlo\u017een\u00fdm pozorovateln\u00fdm z\u00e1konitostem evolu\u010dn\u00edho procesu, kter\u00fd zformoval komplexn\u00ed a vz\u00e1jemn\u011b prov\u00e1zan\u00fd vesm\u00edr, jsou ve v\u011bt\u0161in\u011b akademick\u00fdch, ekonomick\u00fdch, pr\u00e1vn\u00edch a n\u00e1bo\u017eensk\u00fdch instituc\u00ed z\u00e1kladem dominantn\u00edho z\u00e1padn\u00edho sv\u011bton\u00e1zoru st\u00e1le t\u00e9mata odcizen\u00ed, odd\u011blov\u00e1n\u00ed a mechanizace, kter\u00e9 vypl\u00fdvaj\u00ed z&nbsp;renesan\u010dn\u00edch spis\u016f Ren\u00e9 Descarta, Francise Bacona a Isaaca Newtona ze 17.&nbsp;stolet\u00ed [3]. Tento line\u00e1rn\u00ed dualistick\u00fd pohled na sv\u011bt stav\u00ed lidstvo mimo p\u0159irozen\u00e9 fungov\u00e1n\u00ed pozemsk\u00e9ho spole\u010denstv\u00ed a \u010dasto u\u010d\u00ed antropocentrismu, kter\u00fd vlastn\u00ed hodnotu jin\u00fdch bytost\u00ed ignoruje. Lidstvo je vn\u00edm\u00e1no, jako by se nach\u00e1zelo jaksi &#8222;mimo&#8220; p\u0159\u00edrodu a nezodpov\u00eddalo se jej\u00edm z\u00e1kon\u016fm a funkc\u00edm. P\u0159esto\u017ee je blahobyt lidstva zcela z\u00e1visl\u00fd na zdrav\u00e9m fungov\u00e1n\u00ed z\u00e1kladn\u00edch syst\u00e9m\u016f Zem\u011b, jako je \u010dist\u00e1 atmosf\u00e9ra a dynami\u010dt\u00ed mikrobi v&nbsp;p\u016fd\u011b, hlavn\u00ed z\u00e1padn\u00ed instituce tuto dynamiku Zem\u011b jen z\u0159\u00eddka pova\u017euj\u00ed za prvotn\u00ed zdroj a za udr\u017eovatele \u017eivotn\u00edch sil. Pr\u00e1vn\u00ed struktury a spr\u00e1va v\u011bc\u00ed ve\u0159ejn\u00fdch jsou stejn\u011b nedostate\u010dn\u00e9, pokud jde o uzn\u00e1n\u00ed, \u017ee prvotn\u00edm d\u00e1rcem pr\u00e1va je samotn\u00e1 Zem\u011b [4].<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Situov\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody v&nbsp;r\u00e1mci hnut\u00ed pr\u00e1vn\u00ed v\u011bdy Zem\u011b<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Pr\u00e1va Zem\u011b<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hlubinn\u00fd ekolog, &#8222;geolog&#8220; a znalec Zem\u011b Thomas Berry [5] (1914-2009) navrhl v&nbsp;roce 1999 ve sv\u00e9 knize <em>The Great Work: Our Way Into the Future (<\/em>\u010desky: <em>Velk\u00e9 d\u00edlo: na\u0161e cesta do budoucnosti, <\/em>Malvern 2021<em>)<\/em>, \u017ee v\u00fdzvou pro dne\u0161n\u00ed lidstvo je, abychom pochopili z\u00e1kladn\u00ed syst\u00e9mov\u00e9 p\u0159\u00ed\u010diny ekologick\u00e9 krize a prom\u011bnili n\u00e1\u0161 vztah k&nbsp;p\u0159\u00edrod\u011b z&nbsp;destruktivn\u00edho na vz\u00e1jemn\u011b prosp\u011b\u0161n\u00fd[6]. Berry tvrd\u00ed, \u017ee etick\u00e9 jedn\u00e1n\u00ed a \u017eivot v&nbsp;r\u00e1mci p\u0159irozen\u00fdch mo\u017enost\u00ed Zem\u011b vy\u017eaduj\u00ed, abychom se zam\u011b\u0159ili na novou pr\u00e1vn\u00ed v\u011bdu, na nov\u00fd zp\u016fsob \u0159\u00edzen\u00ed sebe sama pro v\u00fdzvy a mo\u017enosti 21.&nbsp;stolet\u00ed tak, abychom ochr\u00e1nili integritu pozemsk\u00fdch syst\u00e9m\u016f [7].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Berry tvrd\u00ed, \u017ee hlavn\u00ed p\u0159\u00ed\u010dinou ekologick\u00e9 krize je antropocentrismus \u2013 p\u0159esv\u011bd\u010den\u00ed lid\u00ed v&nbsp;pr\u016fmyslov\u00e9m sv\u011bt\u011b, \u017ee jsme n\u011bjak\u00fdm zp\u016fsobem od ostatn\u00ed p\u0159\u00edrody odd\u011bleni a \u017ee jsme d\u016fle\u017eit\u011bj\u0161\u00ed, ne\u017e je ona [8]. Dokl\u00e1d\u00e1, \u017ee tento antropocentrick\u00fd pohled na sv\u011bt je z\u00e1kladem v\u0161ech vl\u00e1dnouc\u00edch struktur sou\u010dasn\u00e9 pr\u016fmyslov\u00e9 spole\u010dnosti \u2013 ekonomiky, vzd\u011bl\u00e1v\u00e1n\u00ed, n\u00e1bo\u017eenstv\u00ed, pr\u00e1va \u2013 a \u017ee podporuje vn\u00edm\u00e1n\u00ed p\u0159\u00edrodn\u00edho sv\u011bta jako pouh\u00e9ho souboru objekt\u016f pro lidsk\u00e9 vyu\u017eit\u00ed [9]. Podrobn\u011b vysv\u011btluje, \u017ee &#8222;velk\u00e9 d\u00edlo, kter\u00e9 je p\u0159ed n\u00e1mi, \u00fakol p\u0159en\u00e9st modern\u00ed pr\u016fmyslovou civilizaci z&nbsp;jej\u00edho sou\u010dasn\u00e9ho ni\u010div\u00e9ho vlivu na Zemi do p\u0159\u00edzniv\u011bj\u0161\u00edho modu p\u0159\u00edtomnosti&#8220; [10], vy\u017eaduje, aby sou\u010dasn\u00e9 vl\u00e1dnouc\u00ed struktury a z\u00e1kony uznaly kosmologick\u00fd p\u016fvod lidsk\u00e9ho druhu a jeho vz\u00e1jemn\u011b z\u00e1visl\u00e9, propojen\u00e9 m\u00edsto v&nbsp;r\u00e1mci jednoho komplexn\u00edho spole\u010denstv\u00ed Zem\u011b [11]. Nedostate\u010dn\u00fd respekt ke zdrav\u00ed Zem\u011b p\u0159eru\u0161uje \u017eivotn\u011b d\u016fle\u017eit\u00e9 evolu\u010dn\u00ed procesy, do nich\u017e je pozemsk\u00e9 spole\u010denstv\u00ed aktivn\u011b zapojeno\u201c [12]. Berry poznamenal, \u017ee navzdory rozs\u00e1hl\u00fdm v\u011bdeck\u00fdm poznatk\u016fm \u017eij\u00ed pr\u016fmyslov\u00e9 spole\u010dnosti nad\u00e1le ve fale\u0161n\u00e9m dualismu, kter\u00fd n\u00e1s u\u010d\u00ed, \u017ee lidstvo je od ostatn\u00edho p\u0159\u00edrodn\u00edho sv\u011bta odd\u011blen\u00e9 a vzd\u00e1len\u00e9 [13]. Pod pojmem &#8222;spole\u010denstv\u00ed Zem\u011b&#8220; Thomas Berry rozum\u00ed v\u0161echny lidsk\u00e9 a &#8222;jin\u00e9 ne\u017e lidsk\u00e9&#8220; formy \u017eivota a sou\u010d\u00e1sti planety \u2013 zv\u00ed\u0159ata, rostliny, \u0159eky, hory, sk\u00e1ly, atmosf\u00e9ru \u2013 celou na\u0161i Zemi [23]. To znamen\u00e1, \u017ee pr\u00e1vn\u00ed v\u011bda Zem\u011b je ch\u00e1p\u00e1na jako explicitn\u00ed obhajoba my\u0161lenky lidsk\u00fdch spole\u010dnost\u00ed, kter\u00e9 \u017eij\u00ed v&nbsp;r\u00e1mci &#8222;pravidel&#8220; \u010di limit\u016f p\u0159\u00edrodn\u00edho sv\u011bta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Za druh\u00e9,<\/strong> pr\u00e1vn\u00ed v\u011bda Zem\u011b vn\u00edm\u00e1 Zemi jako vz\u00e1jemn\u011b propojen\u00e9 spole\u010denstv\u00ed a prosazuje existenci zalo\u017eenou na vztaz\u00edch mezi lidstvem a ostatn\u00edm spole\u010denstv\u00edm Zem\u011b. Proto je \u00fakolem pr\u00e1vn\u00ed v\u011bdy Zem\u011b rozv\u00edjet a prosazovat kulturn\u00ed, pr\u00e1vn\u00ed \u2013 a dokonce i duchovn\u00ed \u2013 zm\u011bny, kter\u00e9 uzn\u00e1vaj\u00ed tato ji\u017e existuj\u00edc\u00ed &#8222;pr\u00e1va&#8220; a zajistit pr\u00e1vn\u00ed zohledn\u011bn\u00ed a ochranu t\u011bchto pr\u00e1v.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na toto pojet\u00ed pr\u00e1v vznikaj\u00edc\u00edch z&nbsp;existence navazuje <strong>\u010dtvrt\u00fd <\/strong>a z\u00e1sadn\u00ed prvek pr\u00e1vn\u00ed v\u011bdy Zem\u011b: my\u0161lenka pozemsk\u00e9 demokracie. Mnoz\u00ed zast\u00e1nci pr\u00e1v p\u0159\u00edrody zasazuj\u00ed tato pr\u00e1va do r\u00e1mce &#8222;demokracie Zem\u011b&#8220;. Demokracie Zem\u011b je definov\u00e1na jako pokus o spojen\u00ed ekocentrick\u00e9 etiky s&nbsp;hlub\u0161\u00edmi formami lidsk\u00e9 demokracie a ve\u0159ejn\u00e9 participace [33]. Prosazuje my\u0161lenku, \u017ee v\u0161echny lidsk\u00e9 i nelidsk\u00e9 formy \u017eivota jsou zrozeny ze Zem\u011b a \u017ee my v\u0161ichni jako evolu\u010dn\u00ed souputn\u00edci m\u00e1me pr\u00e1vo existovat, prosperovat a vyv\u00edjet se. Z&nbsp;hlediska lidsk\u00fdch vztah\u016f je demokracie Zem\u011b koncept, kter\u00fd zkoum\u00e1 moc, privilegia a nerovnost a odm\u00edt\u00e1 je ve prosp\u011bch my\u0161lenky, \u017ee v\u0161ichni lid\u00e9 maj\u00ed pr\u00e1vo na vlastn\u00ed sebeur\u010den\u00ed, zejm\u00e9na pokud jde o spr\u00e1vu Zem\u011b v&nbsp;r\u00e1mci jejich m\u00edstn\u00edch komunit. Je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee v&nbsp;r\u00e1mci p\u0159\u00edstupu zalo\u017een\u00e9ho na pr\u00e1vn\u00ed v\u011bd\u011b Zem\u011b jsou lidsk\u00e1 pr\u00e1va vz\u00e1jemn\u011b z\u00e1vislou a souvzta\u017enou podmno\u017einou pr\u00e1v Zem\u011b; lidstvo nem\u016f\u017ee b\u00fdt zdrav\u00e9 a na\u0161e lidsk\u00e1 pr\u00e1va nemohou b\u00fdt zaji\u0161t\u011bna, pokud Zem\u011b sm\u011b\u0159uje k&nbsp;vy\u010derp\u00e1n\u00ed a nadm\u011brn\u00e9 extrakci.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jak ale m\u016f\u017eeme sou\u010dasn\u00fd syst\u00e9m zm\u011bnit a p\u0159ej\u00edt k&nbsp;pozemsk\u00e9 jurisdikci spr\u00e1vy v\u011bc\u00ed ve\u0159ejn\u00fdch? Na\u0161t\u011bst\u00ed existuje mno\u017estv\u00ed lid\u00ed, komunitn\u00edch organizac\u00ed a domorod\u00fdch v\u016fdc\u016f, kte\u0159\u00ed vykon\u00e1vaj\u00ed sv\u00e9 Velk\u00e9 d\u00edlo a jdou p\u0159\u00edkladem. K&nbsp;hnut\u00ed za pr\u00e1va a demokracii Zem\u011b se hl\u00e1s\u00ed lid\u00e9 ze v\u0161ech kultur, zem\u00ed a profes\u00ed a tato multikulturn\u00ed a multidisciplin\u00e1rn\u00ed reakce na pr\u00e1vn\u00ed v\u011bdu Zem\u011b je jednou z&nbsp;jeho nejsiln\u011bj\u0161\u00edch str\u00e1nek. Pot\u0159ebujeme, aby se do vytv\u00e1\u0159en\u00ed nov\u00fdch z\u00e1kon\u016f a syst\u00e9m\u016f spr\u00e1vy, kter\u00e9 budou zam\u011b\u0159eny na Zemi, zapojili lid\u00e9 ze v\u0161ech oblast\u00ed \u017eivota. V&nbsp;roce 2010 p\u0159ijala Bol\u00edvie n\u00e1rodn\u00ed z\u00e1kon, nazvan\u00fd Z\u00e1kon pr\u00e1v Matky Zem\u011b, kter\u00fd Matku Zemi definuje jako &#8222;kolektivn\u00ed subjekt ve\u0159ejn\u00e9ho z\u00e1jmu&#8220; a jako nositelku p\u0159irozen\u00fdch pr\u00e1v uveden\u00fdch v&nbsp;z\u00e1kon\u011b. V&nbsp;pr\u00e1vn\u00edch p\u0159edpisech bylo rovn\u011b\u017e stanoveno z\u0159\u00edzen\u00ed zvl\u00e1\u0161tn\u00edho \u00fa\u0159adu ombudsmana pro pr\u00e1va Matky Zem\u011b, podobn\u00e9ho \u00fa\u0159adu, kter\u00fd existuje pro lidsk\u00e1 pr\u00e1va [35].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ekv\u00e1dorsk\u00fd a bolivijsk\u00fd p\u0159\u00edstup maj\u00ed dva d\u016fle\u017eit\u00e9 prvky: p\u0159izn\u00e1vaj\u00ed p\u0159\u00edrod\u011b pozitivn\u00ed pr\u00e1va \u2013 v\u010detn\u011b pr\u00e1va existovat, obnovovat se a regenerovat. P\u0159izn\u00e1vaj\u00ed tak\u00e9 \u0161irokou pr\u00e1vn\u00ed subjektivitu, kter\u00e1 umo\u017e\u0148uje ka\u017ed\u00e9mu vystupovat jm\u00e9nem p\u0159\u00edrody a h\u00e1jit jej\u00ed pr\u00e1va. Nap\u0159\u00edklad v&nbsp;Ekv\u00e1doru mohou v\u0161echny osoby, komunity, n\u00e1rody a n\u00e1rodnosti po\u017eadovat, aby ekv\u00e1dorsk\u00e9 \u00fa\u0159ady prosazovaly pr\u00e1va p\u0159\u00edrody a vym\u00e1haly jejich dodr\u017eov\u00e1n\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zat\u00edmco v&nbsp;Bol\u00edvii se z\u00e1kony o pr\u00e1vech p\u0159\u00edrody p\u0159\u00edli\u0161 neosv\u011bd\u010dily, v&nbsp;Ekv\u00e1doru bylo vedeno n\u011bkolik des\u00edtek spor\u016f na z\u00e1klad\u011b ustanoven\u00ed \u00fastavy o pr\u00e1vech p\u0159\u00edrody a p\u0159ibli\u017en\u011b polovina z&nbsp;nich byla \u00fasp\u011b\u0161n\u00e1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud jde o z\u00e1kony pr\u00e1v p\u0159\u00edrody, je obvykle m\u00e9n\u011b zn\u00e1mo, \u017ee dva roky p\u0159edt\u00edm, ne\u017e se objevila ekv\u00e1dorsk\u00e1 \u00fastavn\u00ed ustanoven\u00ed, p\u0159ijaly m\u00edstn\u00ed komunity v&nbsp;USA prvn\u00ed vyhl\u00e1\u0161ky o pr\u00e1vech p\u0159\u00edrody na sv\u011bt\u011b a dnes existuje v\u00edce ne\u017e t\u0159icet m\u00edstn\u00edch vyhl\u00e1\u0161ek, kter\u00e9 uzn\u00e1vaj\u00ed z\u00e1konn\u00e1 pr\u00e1va p\u0159\u00edrody a m\u00edstn\u00edch komunit. V\u0161echny tyto vyhl\u00e1\u0161ky potvrzuj\u00ed pozitivn\u00ed pr\u00e1va p\u0159\u00edrody na existenci, na jej\u00ed rozkv\u011bt a rozvoj a vyhla\u0161uj\u00ed pr\u00e1va m\u00edstn\u00edch komunit h\u00e1jit a br\u00e1nit tato pr\u00e1va v&nbsp;r\u00e1mci p\u0159\u00edslu\u0161n\u00e9 jurisdikce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tento inovativn\u00ed p\u0159\u00edstup, spo\u010d\u00edvaj\u00edc\u00ed ve vyu\u017e\u00edv\u00e1n\u00ed m\u00edstn\u00ed komun\u00e1ln\u00ed legislativy k&nbsp;p\u0159ij\u00edm\u00e1n\u00ed z\u00e1kon\u016f o pr\u00e1vech p\u0159\u00edrody a komunitn\u00edch pr\u00e1vech uvedl v&nbsp;\u017eivot v\u00fd\u0161e zm\u00edn\u011bn\u00fd Community Environmental Legal Defense Fund (CELDF \/ Fond komunitn\u00ed pr\u00e1vn\u00ed ochrany \u017eivotn\u00edho prost\u0159ed\u00ed), ve\u0159ejn\u011b prosp\u011b\u0161n\u00e1 advok\u00e1tn\u00ed firma zalo\u017een\u00e1 Thomasem Linzeyem a Mari Margilovou. I kdy\u017e se tento v\u00fdvoj ozna\u010duje jako z\u00e1kony o pr\u00e1vech p\u0159\u00edrody, tyto z\u00e1kony maj\u00ed velmi odli\u0161n\u00fd p\u016fvod a potenci\u00e1ln\u011b odli\u0161n\u00e9 v\u00fdsledky ne\u017e z\u00e1kony o pr\u00e1vech p\u0159\u00edrody v&nbsp;jin\u00fdch jurisdikc\u00edch, proto\u017ee vznikly na z\u00e1klad\u011b specifick\u00fdch koloni\u00e1ln\u00edch pr\u00e1vn\u00edch struktur Nov\u00e9ho Z\u00e9landu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ka\u017ed\u00fd z&nbsp;t\u011bchto t\u0159\u00ed z\u00e1kon\u016f o pr\u00e1vn\u00ed subjektivit\u011b vznikl na z\u00e1klad\u011b dohod o narovn\u00e1n\u00ed podle smlouvy z&nbsp;Waitangi, je\u017e zahrnovaly roky \u2013 a v&nbsp;p\u0159\u00edpad\u011b \u0159eky Whanganui desetilet\u00ed \u2013 jedn\u00e1n\u00ed mezi novoz\u00e9landskou vl\u00e1dou a p\u0159\u00edslu\u0161n\u00fdmi maorsk\u00fdmi kmeny. Ve v\u0161ech p\u0159\u00edpadech, kdy bylo dosa\u017eeno dohody, byla tato dohoda o narovn\u00e1n\u00ed zdokumentov\u00e1na v&nbsp;Protokolu o porozum\u011bn\u00ed a byly p\u0159ijaty pr\u00e1vn\u00ed p\u0159edpisy, kter\u00e9 stanovily nov\u00e9 pr\u00e1vn\u00ed postaven\u00ed ka\u017ed\u00e9ho jednotliv\u00e9ho ekosyst\u00e9mu a zp\u016fsoby jeho spr\u00e1vy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na rozd\u00edl od \u0161irok\u00e9ho postaven\u00ed, kter\u00e9 umo\u017e\u0148uj\u00ed z\u00e1kony o pr\u00e1vech p\u0159\u00edrody v&nbsp;Ekv\u00e1doru, Bol\u00edvii a v&nbsp;USA, jsou pr\u00e1vn\u00ed \u00fapravy na Nov\u00e9m Z\u00e9land\u011b u\u017e\u0161\u00ed, proto\u017ee ka\u017ed\u00fd ekosyst\u00e9m s&nbsp;&#8222;pr\u00e1vn\u00ed subjektivitou &#8220; m\u00e1 v\u00fdslovn\u011b definovan\u00e9 str\u00e1\u017ece, kte\u0159\u00ed za n\u011bj mohou mluvit a vystupovat. Ka\u017ed\u00fd z&nbsp;t\u011bchto nov\u00fdch z\u00e1kon\u016f tak\u00e9 uzn\u00e1v\u00e1 kulturn\u00ed vazbu a odpov\u011bdnost, kterou maj\u00ed k&nbsp;t\u011bmto ekosyst\u00e9m\u016fm maorsk\u00e9 kmeny.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159esto\u017ee tyto z\u00e1kony vznikly z&nbsp;jedine\u010dn\u00e9ho kulturn\u00edho kontextu Nov\u00e9ho Z\u00e9landu, je pozoruhodn\u00e9, \u017ee v&nbsp;zem\u00edch jako je Indie, Kolumbie a Banglad\u00e9\u0161, kter\u00e9 nemaj\u00ed \u017e\u00e1dnou legislativu umo\u017e\u0148uj\u00edc\u00ed uzn\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody, vydaly soudy rozhodnut\u00ed, kter\u00e1 vych\u00e1zej\u00ed z&nbsp;novoz\u00e9landsk\u00fdch p\u0159\u00edstup\u016f a pr\u00e1vn\u011b potvrzuj\u00ed, \u017ee ur\u010dit\u00e9 ekosyst\u00e9my mus\u00ed b\u00fdt uzn\u00e1ny jako &#8222;\u017eiv\u00e9 bytosti&#8220; a mus\u00ed m\u00edt sv\u00e1 vlastn\u00ed z\u00e1konn\u00e1 pr\u00e1va.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V b\u0159eznu 2017 Nejvy\u0161\u0161\u00ed soud st\u00e1tu Uttar\u00e1khand, kter\u00fd se nach\u00e1z\u00ed na severn\u00ed hranici Indie a zahrnuje prameny \u0159eky Gangy a tak\u00e9 \u010d\u00e1st Him\u00e1laje, prohl\u00e1sil, \u017ee \u201e\u0159eky Ganga a Jamuna a v\u0161echny jejich p\u0159\u00edtoky, potoky, ka\u017ed\u00e1 p\u0159\u00edrodn\u00ed voda tekouc\u00ed trvale nebo p\u0159eru\u0161ovan\u011b t\u011bmito \u0159ekami, se prohla\u0161uj\u00ed za leg\u00e1ln\u00ed, z\u00e1konem uzn\u00e1van\u00e9 osoby, za \u017eiv\u00e9 entity, kter\u00e9 maj\u00ed postaven\u00ed pr\u00e1vnick\u00e9 osoby se v\u0161emi odpov\u00eddaj\u00edc\u00edmi pr\u00e1vy, povinnostmi a z\u00e1vazky \u017eiv\u00e9 osoby za \u00fa\u010delem ochrany a zachov\u00e1n\u00ed \u0159ek Gangy a Jamuny.\u201c<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toto soudn\u00ed rozhodnut\u00ed bylo v&nbsp;Indii pom\u011brn\u011b sporn\u00e9 a bylo proti n\u011bmu pod\u00e1no z&nbsp;n\u011bkolika d\u016fvod\u016f odvol\u00e1n\u00ed ve snaze objasnit d\u016fsledky rozhodnut\u00ed, v\u010detn\u011b odkazu na &#8222;z\u00e1vazky&#8220; ekosyst\u00e9m\u016f. Zaj\u00edmav\u00e9 bylo to, \u017ee m\u00edstn\u00edm komunit\u00e1m a \u0159ece byla p\u0159izn\u00e1na pr\u00e1va. Pr\u00e1va \u0159eky (odli\u0161n\u00e1 od pr\u00e1v komunit) spo\u010d\u00edvaj\u00ed v&nbsp;jej\u00ed ochran\u011b, zachov\u00e1n\u00ed, \u00fadr\u017eb\u011b a obnov\u011b ze strany st\u00e1tu a m\u00edstn\u00edch spole\u010denstv\u00ed. Soud vydal \u0159adu p\u0159\u00edkaz\u016f k&nbsp;proveden\u00ed sv\u00e9ho rozhodnut\u00ed, v\u010detn\u011b toho, aby pr\u00e1va \u0159eky zastupoval opatrovn\u00edk \u2013 jeden z\u00e1stupce vl\u00e1dy a jeden z\u00e1stupce \u017ealuj\u00edc\u00ed komunity \u2013, a v\u00fdslovn\u011b se p\u0159itom odvolal na model Te Awa Tupua (\u0159eka Whanganui) z&nbsp;Nov\u00e9ho Z\u00e9landu. Za\u010d\u00e1tkem tohoto roku byla tak\u00e9 uzn\u00e1na z\u00e1konn\u00e1 pr\u00e1va pro celou oblast Amazonky v&nbsp;Kolumbii [38].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I kdy\u017e se p\u0159\u00edpad \u0159eky Atrato odvol\u00e1v\u00e1 na pr\u00e1vn\u00ed model \u0159eky Whanganui, jde sp\u00ed\u0161e o &#8222;sm\u011bs&#8220; novoz\u00e9landsk\u00e9ho p\u0159\u00edstupu a p\u0159\u00edstup\u016f k&nbsp;pr\u00e1v\u016fm p\u0159\u00edrody, kter\u00e9 se rozvinuly v&nbsp;Ekv\u00e1doru a Bol\u00edvii. &#8222;Biokulturn\u00ed pr\u00e1va&#8220; \u0159eky Atrato zahrnuj\u00ed ochranu, zachov\u00e1n\u00ed, \u00fadr\u017ebu a obnovu \u0159eky, co\u017e je jazyk podobn\u00fd z\u00e1kon\u016fm o pr\u00e1vech p\u0159\u00edrody; a po\u017eaduj\u00ed, aby m\u00edstn\u00ed obyvatel\u00e9 byli zmocn\u011bni k&nbsp;\u0159\u00e1dn\u00e9 spr\u00e1v\u011b sv\u00e9 \u0159eky, co\u017e p\u0159edstavuje v\u00fdznamn\u00e9 pos\u00edlen\u00ed role, kterou mohou hr\u00e1t pr\u00e1va p\u0159i podpo\u0159e demokracie Zem\u011b [39].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Mezin\u00e1rodn\u00ed iniciativy a prohl\u00e1\u0161en\u00ed <\/em>Krom\u011b iniciativ v&nbsp;jednotliv\u00fdch zem\u00edch dnes v\u00edce ne\u017e osmdes\u00e1t organizac\u00ed z&nbsp;cel\u00e9ho sv\u011bta spolupracuje v&nbsp;r\u00e1mci Glob\u00e1ln\u00ed aliance pro pr\u00e1va p\u0159\u00edrody (Global Alliance for the Rights of Nature, d\u00e1le jen &#8222;Glob\u00e1ln\u00ed aliance&#8220;) na prosazov\u00e1n\u00ed z\u00e1konn\u00fdch pr\u00e1v pro spole\u010denstv\u00ed Zem\u011b [40]. Prvn\u00ed z&nbsp;nich je <em>V\u0161eobecn\u00e1 deklarace pr\u00e1v Matky Zem\u011b <\/em>(UDRME) [41], co\u017e je prohl\u00e1\u0161en\u00ed, kter\u00e9 prosazuje pr\u00e1va v\u0161ech \u010dlen\u016f pozemsk\u00e9ho spole\u010denstv\u00ed na existenci, prosperitu a rozvoj. Tato deklarace nen\u00ed v&nbsp;sou\u010dasn\u00e9 dob\u011b uzn\u00e1na v&nbsp;pr\u00e1vn\u00edm syst\u00e9mu vytvo\u0159en\u00e9m n\u00e1rodn\u00edmi st\u00e1ty, p\u0159edstavuje v\u0161ak hodnoty, na nich\u017e se shodly tis\u00edce \u010dlen\u016f ob\u010dansk\u00e9 spole\u010dnosti. Odhaduje se, \u017ee Lidov\u00e9ho kongresu, na n\u011bm\u017e byla deklarace vytvo\u0159ena, se z\u00fa\u010dastnilo v\u00edce ne\u017e t\u0159icet p\u011bt tis\u00edc lid\u00ed ze sto zem\u00ed. Druhou iniciativou Glob\u00e1ln\u00ed aliance je vytvo\u0159en\u00ed <em>Mezin\u00e1rodn\u00edho tribun\u00e1lu pro pr\u00e1va p\u0159\u00edrody<\/em>. C\u00edlem tribun\u00e1lu je projedn\u00e1vat p\u0159\u00edpady \u00fadajn\u00e9ho poru\u0161ov\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody a vyd\u00e1vat doporu\u010den\u00ed ohledn\u011b vhodn\u00fdch n\u00e1pravn\u00fdch opat\u0159en\u00ed a obnovy. Tribun\u00e1l vznikl jako reakce na obavy \u010dlen\u016f Glob\u00e1ln\u00ed aliance, \u017ee st\u00e1tem schv\u00e1len\u00e9 z\u00e1kony umo\u017e\u0148uj\u00ed p\u00e1ch\u00e1n\u00ed krutost\u00ed na p\u0159\u00edrod\u011b. Tribun\u00e1l uspo\u0159\u00e1dal sly\u0161en\u00ed, kter\u00e1 upozornila na poru\u0161ov\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody po cel\u00e9m sv\u011bt\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pr\u00e1va p\u0159\u00edrody a demokracie Zem\u011b \u2013 ned\u00e1vn\u00fd v\u00fdvoj v&nbsp;Austr\u00e1lii a Tichomo\u0159\u00ed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">V listopadu 2018 se na univerzit\u011b v&nbsp;Aucklandu se\u0161la skupina v\u011bdc\u016f, pr\u00e1vn\u00edk\u016f a region\u00e1ln\u00edch skupin zab\u00fdvaj\u00edc\u00edch se ochranou \u017eivotn\u00edho prost\u0159ed\u00ed a domorod\u00fdch n\u00e1rod\u016f Tichomo\u0159\u00ed, aby spole\u010dn\u011b diskutovaly o vytvo\u0159en\u00ed Region\u00e1ln\u00ed \u00famluvy o pr\u00e1vech Tich\u00e9ho oce\u00e1nu. Bylo vytvo\u0159eno &#8222;Prohl\u00e1\u0161en\u00ed o principech&#8220; [42] jako zp\u016fsob, jak artikulovat kulturn\u00ed a pr\u00e1vn\u00ed my\u0161len\u00ed, kter\u00e9 projekt rozv\u00edj\u00ed, a jak vyzvat potenci\u00e1ln\u00ed z\u00e1jemce, aby se do hnut\u00ed zapojili. Tento projekt p\u0159edstavuje sbl\u00ed\u017een\u00ed n\u011bkolika r\u016fzn\u00fdch p\u0159\u00edstup\u016f k&nbsp;uzn\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody. Prosazuje uzn\u00e1n\u00ed Tich\u00e9ho oce\u00e1nu jako \u017eiv\u00e9 entity s&nbsp;pr\u00e1vem na existenci, prosperitu a v\u00fdvoj a uzn\u00e1v\u00e1 tak\u00e9 kulturn\u00ed tradice obyvatel Tichomo\u0159\u00ed, kte\u0159\u00ed maj\u00ed k&nbsp;Tich\u00e9mu oce\u00e1nu hlubok\u00e9 kulturn\u00ed a duchovn\u00ed vazby. Z\u00e1sadn\u00ed prioritou je v\u0161ak partnersk\u00fdm zp\u016fsobem spolupracovat s&nbsp;kolegy z&nbsp;domorod\u00fdch n\u00e1rod\u016f a prozkoumat, jak by mohl b\u00fdt p\u0159\u00edstup &#8222;pr\u00e1v p\u0159\u00edrody&#8220; upraven v&nbsp;Austr\u00e1lii tak, aby podporoval \u2013 a nepodkop\u00e1val \u2013 st\u00e1vaj\u00edc\u00ed starobyl\u00e9 z\u00e1kony domorod\u00fdch lid\u00ed na tomto kontinentu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0158ada iniciativ, prohl\u00e1\u0161en\u00ed a dokument\u016f domorod\u00fdch n\u00e1rod\u016f ji\u017e obsahuje odkaz na pr\u00e1va p\u0159\u00edrody. V&nbsp;roce 2016 vytvo\u0159ili p\u0159\u00edslu\u0161n\u00edci domorod\u00fdch n\u00e1rod\u016f v&nbsp;oblasti, kter\u00e1 je nyn\u00ed zn\u00e1m\u00e1 jako Kimberley, historickou deklaraci \u2013 Fitzroy River Declaration (Deklarace \u0159eky Fitzroy) \u2013 kter\u00e1 vyty\u010duje jejich z\u00e1m\u011br chr\u00e1nit a spravovat \u0159eku a kter\u00e1 tak\u00e9 uzn\u00e1v\u00e1, \u017ee &#8222;\u0159eka je \u017eivou bytost\u00ed p\u0159edk\u016f a m\u00e1 pr\u00e1vo na \u017eivot&#8220; [43].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V roce 2017 podepsalo \u0161estn\u00e1ct domorod\u00fdch n\u00e1rod\u016f ze severn\u00ed \u010d\u00e1sti povod\u00ed Murray-Darling smlouvu o spolupr\u00e1ci a jednotn\u00e9m vystupov\u00e1n\u00ed v&nbsp;ot\u00e1zk\u00e1ch, kter\u00e9 jsou pro n\u011b d\u016fle\u017eit\u00e9 [44]. Smlouva, zn\u00e1m\u00e1 jako Svaz suver\u00e9nn\u00edch prvn\u00edch n\u00e1rod\u016f severn\u00ed \u010d\u00e1sti povod\u00ed Murray-Darling, se rovn\u011b\u017e zavazuje dodr\u017eovat &#8222;pr\u00e1va Matky Zem\u011b&#8220;, a to n\u00e1sledovn\u011b: &#8222;Pr\u00e1va Matky Zem\u011b jsou zast\u00e1v\u00e1na v\u0161emi n\u00e1rody\u2026 A my se zavazujeme zajistit &#8222;respekt&#8220; a ochranu jej\u00edch nezadateln\u00fdch pr\u00e1v a v\u0161eho p\u0159\u00edrodn\u00edho. Uzn\u00e1v\u00e1me, \u017ee tyto z\u00e1ruky jsou absolutn\u00edmi neodmysliteln\u00fdmi pr\u00e1vy lidsk\u00e9ho stavu&#8220; [45].<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V roce 2017 tak\u00e9 vl\u00e1da autralsk\u00e9ho st\u00e1tu Victoria schv\u00e1lila z\u00e1kon o ochran\u011b \u0159eky Yarra (Wilip-gin Birrarung Murron), kter\u00fd umo\u017e\u0148uje identifikovat \u0159eku Yarra a stovky ve\u0159ejn\u00fdch pozemk\u016f, jimi\u017e prot\u00e9k\u00e1, jako jednu \u017eivou integrovanou p\u0159\u00edrodn\u00ed entitu, kterou je pot\u0159eba chr\u00e1nit a zu\u0161lech\u0165ovat. Po n\u011bkolika letech workshop\u016f a diskus\u00ed, kter\u00e9 AELA vedla s&nbsp;m\u00edstn\u00edmi komunitami po cel\u00e9 Austr\u00e1lii, se za\u010d\u00e1tkem roku 2018 objevila \u0159ada komunitn\u00edch iniciativ, kter\u00e9 uva\u017euj\u00ed o tom, jak mohou pr\u00e1va p\u0159\u00edrody zaujmout p\u0159edstavivost lid\u00ed zp\u016fsobem, kter\u00fd tradi\u010dn\u00ed environment\u00e1ln\u00ed pr\u00e1vo nezn\u00e1, a jak by mohly b\u00fdt struktury a strategie pr\u00e1v p\u0159\u00edrody p\u0159ijaty lidmi, kte\u0159\u00ed se sna\u017e\u00ed podporovat demokracii Zem\u011b.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V b\u0159eznu 2018 se se\u0161lo v&nbsp;Z\u00e1padn\u00ed Austr\u00e1lii v\u00edc ne\u017e sto m\u00edstn\u00edch lid\u00ed na podporu \u0159eky Margaret. Jejich n\u00e1pisy, transparenty a strategie se soust\u0159edily na to, aby \u0159eka dostala sv\u016fj vlastn\u00ed hlas a sv\u00e1 vlastn\u00ed z\u00e1konn\u00e1 pr\u00e1va. Jeden z&nbsp;m\u00edstn\u00edch obh\u00e1jc\u016f pr\u00e1v \u0159eky \u0159ekl, \u017ee lid\u00e9 &#8222;pochopili my\u0161lenku uzn\u00e1n\u00ed \u0159eky jako \u017eiv\u00e9 entity, proto\u017ee my v\u0161ichni v\u00edme, \u017ee je v\u00edc ne\u017e jen zdrojem, \u017ee je \u017eiv\u00e1 a m\u00e1 pr\u00e1vo na existenci.&#8220;[48]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V poho\u0159\u00ed Modr\u00e9 hory (Blue Mountains) spolupracovali \u010dlenov\u00e9 zdej\u0161\u00ed komunity, kte\u0159\u00ed se ob\u00e1vaj\u00ed ohro\u017een\u00ed t\u00e9to oblasti sv\u011btov\u00e9ho d\u011bdictv\u00ed, s&nbsp;agenturou AELA na p\u0159\u00edprav\u011b prohl\u00e1\u0161en\u00ed m\u00edstn\u00ed rady, kter\u00e9, jak doufaj\u00ed, z\u00edsk\u00e1 podporu a bude se zasazovat o uzn\u00e1n\u00ed pr\u00e1v p\u0159\u00edrody na m\u00edstn\u00ed \u00farovni v&nbsp;oblasti m\u00edstn\u00ed rady Modr\u00fdch hor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AELA zah\u00e1jila tak\u00e9 novou diskusi o tom, jak zv\u00fd\u0161it ochranu a p\u00e9\u010di o nejv\u011bt\u0161\u00ed spole\u010denstv\u00ed kor\u00e1lov\u00fdch \u00fates\u016f na sv\u011bt\u011b, o Velk\u00fd bari\u00e9rov\u00fd \u00fates. AELA p\u0159ipravila n\u00e1vrhy z\u00e1kon\u016f pro v\u0161echny t\u0159i \u00farovn\u011b australsk\u00e9 vl\u00e1dy \u2013 vzorov\u00fd z\u00e1kon pro m\u00edstn\u00ed rady v&nbsp;povod\u00ed Velk\u00e9ho bari\u00e9rov\u00e9ho \u00fatesu, st\u00e1tn\u00ed z\u00e1kon uzn\u00e1vaj\u00edc\u00ed pr\u00e1va \u00fatesu a n\u00e1vrh zm\u011bny feder\u00e1ln\u00ed \u00fastavy. Tyto modelov\u00e9 z\u00e1kony maj\u00ed uk\u00e1zat, co je v&nbsp;Austr\u00e1lii mo\u017en\u00e9 a jak by mohly b\u00fdt z\u00e1kony o pr\u00e1vech p\u0159\u00edrody vytvo\u0159eny tak, aby zahrnovaly demokracii Zem\u011b a uzn\u00e1n\u00ed pr\u00e1v a povinnost\u00ed domorod\u00fdch n\u00e1rod\u016f v&nbsp;p\u00e9\u010di o krajinu a mo\u0159e [49].<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Z\u00e1v\u011bry<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">P\u0159\u00edstup &#8222;pr\u00e1v p\u0159\u00edrody&#8220; ve sv\u00e9 podstat\u011b \u0159\u00edk\u00e1, \u017ee, slovy Thomase Berryho, tam, &#8222;kde existuje \u017eivot, existuj\u00ed pr\u00e1va&#8220;.
